THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.1622 of 2018 ORDER:
This Writ Petition is filed for the following relief: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue a Writ of Mandamus or any other appropriate Writ, order or direction declaring the action of respondents 2 and 3 in ignoring the L1 bid of the petitioner against the work vide TENDER TITLE :
4APDRP/PRCS/PRED/03/BHEEMILI-001 despite of the fact that the bid of the petitioner was qualified by respondents 2 and 3 and also by the State Technical Committee and proclaiming to cancel the bid as illegal, arbitrary, contrary to the principles of natural justice and consequently direct the respondents to consider the bid of the petitioner."
A perusal of the writ affidavit discloses that the only basis on which the petitioner has filed this Writ Petition is the alleged talk in the department that he being the L1 Contractor is not going to be awarded contract.
It is to be noted that if the contract is awarded to someone ignoring the petitioner's rightful claim, he would have a cause of action to approach the Court. As on date, admittedly, no action has been taken by the respondents. In view of the same, there is
CKR, J W.P.No.1622 of 2018 no cause of action which is prejudicial to the interests of the petitioner for filing the Writ Petition.
This Writ Petition is misconceived and is accordingly, dismissed. However, this order does not preclude the petitioner from approaching the Court as and when cause of action arises. Miscellaneous Petitions, if any pending shall stand dismissed. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J 23rd JANUARY, 2018.
