THE HON'BLE SRI JUSTICE A.V.SESHA SAI W.P.No.14010 of 2015 ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India seeking following relief:- ".... to issue a Writ, order or direction more particularly one in the nature of writ of Mandamus declaring the action of the 2nd respondent in harassing the petitioners by calling them to the police station and interfering with their peaceful life without any complaint, as illegal, arbitrary and in violative of Article 21 of the Constitution and pass such other order or orders as may deem fit and proper in the circumstances of the case." When the matter is taken up for hearing, the written instructions furnished by the Circle Inspector of Police, Kanapuram Haveli Police Station, Khammam District, on 03-06-2015 have been placed on record by the learned Government Pleader. In the said written instructions, it is stated as follows:- "It is respectfully submitted that as per the records, as of now, no complaint whatsoever was received in this respondent police station against the petitioners herein. At no point of time, this respondent summoned the petitioners.
It is submitted that the allegations of the petitioners that this respondent is daily harassing them stating that under what authority they have executed subject sale deeds and he is unnecessarily calling them to the police station and harassing them to disclose as to how they have sold the subject properties of the petitioners herein are absolutely false, baseless and hence the same are denied.
It is pertinent to submit that as a precautionary measure to prevent the police from taking any action in the event of lodging of any complaint against them in future, the petitioners rushed to this Hon'ble Court and filed the present writ petition with false and baseless allegations. It is pertinent to submit that this respondent never summoned the petitioners nor asked them to show their property documents as alleged. It is also humbly submitted that the petitioners herein not at all required in any of the cases registered on the file of this respondent police
station.
I humbly submit that on mere apprehension, the petitioners filed the present writ petition."
On noticing the same, learned counsel for the petitioners has requested this Court to close the writ petition by recording the said instructions. In view of the above, the writ petition is closed by recording the above instructions. No order as to costs. Miscellaneous petitions pending, if any, shall stand closed.
