M/S Saket Pranaam Flat Owners v. Secy., Stamps And Regist., Dept., Hyd., And 3 Others,
HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN AND HON'BLE SRI JUSTICE P. KESHAVA RAO WRIT APPEAL No.639 of 2017 Judgment: (per the Hon'ble the Chief Justice Sri Thottathil B. Radhakrishnan) We have heard the learned counsel for the appellant and the learned counsel for the contesting respondents in extenso. 2.
The issues relating to certain disputes touching the affairs of apartments appear to be the subject matter of the Writ Petition from which this Writ Appeal arises.
3.
This Writ Appeal is against an interlocutory order issued during the course of the aforenoted Writ Petition. Through order dated 11.5.2017, this Court had directed that the operation of the bank account would be restricted in terms of what is stated in the last paragraph thereof.
4.
We are satisfied that the said situation which had operated from 11.5.2017 can continue for the time being to secure the ends of justice, and in the meanwhile, the learned Single Judge would make an effort to dispose of the Writ Petition in accordance with law, at the earliest.
5.
Noticing that different interlocutory applications are pending for impleadment, we clarify that it will be open to the learned Single Judge also to decide on any application that may be filed to modify the aforesaid fact situation without reference to this judgment, if such situation arises after the consideration of the applications for impleadment.
6.
The Writ Appeal is ordered accordingly.
Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
