HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN Civil Revision Petition No.488 of 2017 ORDER:
Aggrieved by the dismissal of her application for impleadment, a third party to a suit for recovery of money on a promissory note has come up with the present revision.
2. Heard the learned counsel for the petitioner.
3. The suit is not either on or for an immovable property. The suit is a simple suit for recovery of money on a promissory note between the respondents 1 and 2.
4. The claim of the petitioner is that in a mortgage suit, filed by the wife of the 1st respondent herein, she is contesting on the ground of purchase made by her. In other words, the claim of the petitioner is with respect to a property, which is not the subject matter of the suit in which she wants to implead herself.
5. Hence, the Civil Revision Petition is dismissed. It will be open to the petitioner to independently work out her remedies. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
