THE HON'BLE SRI JUSTICE C.V.BHASKAR REDDY Contempt Case NO. 1890 of 2016 ORDER:

This Contempt Case is filed alleging violation of orders dated 05.08.2016 passed by this Court in W.V.M.P.Nos.622, 623 & 973 of 2016 in and W.P.No.220 of 2016.

On 11.11.2016 this Court ordered notice before admission, but cognizance has not been taken as required under Section 17 of the Contempt of Courts Act.

Respondent No.1 has filed a counter affidavit stating that respondent No.2 is proceeding with the construction work in accordance with sanctioned plan. It is also stated in the counter affidavit that the petitioner is having dispute with respondent No.2 regarding property and on verification, it is noticed that there is no encroachment as alleged and sketch plan is also enclosed by respondent No.1.

In view of the same, this Contempt Case is closed. However, liberty is granted to the petitioner, if any cause survives, to file fresh application seeking revival of the contempt case in accordance with law.

Miscellaneous petitions, if any pending in this contempt case shall stand dismissed.
