THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.1640 of 2018 ORDER:

In this Writ Petition, petitioners' grievance is that respondents are trying to demolish their houses situated at Rajaaram Village, Dharmapuri Mandal, Jagtial District, to widen the existing road, leading from Dharmapuri to Dontapur, to 30'feet, without following due process of law. It is well settled that no person shall be deprived of his property without following due process of law as right to property is guaranteed under Article 300-A of the Constitution of India.

In those circumstances, the Writ Petition is disposed of with the direction to the respondents not to interfere in any manner with the properties of the petitioners without initiating proceedings or payment of compensation under the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. Miscellaneous Petitions, if any pending shall stand closed. There shall be no order as to costs.
