ORDER
This writ petition is filed seeking the following relief: "to issue an order, direction or writ more particularly one in the nature of Writ of y Mandamus declaring the action of the respondents in not considering the case of the petitioner's son i.e., 2nd petitioner in pursuance of Circular P.D.No.2/2017, dated 21-2-2017 and not paying the service benefits rendered by the 1st petitioner husband as illegal, arbitrary and unjust and consequently direct the respondents to consider the case of the petitioner's son i.e., 2nd petitioner for appointment to the post of RTC Constable, Conductor or any other suitable post and to pay the service benefits rendered by the 1st petitioner husband and pass such further other order or orders as this Hon'ble Court deem fit and proper under the circumstances of the case."
Heard Sri G.Rajesh, learned counsel appearing for the petitioners and Sri B.Mayur Reddy, Learned Standing Counsel appearing for the respondent-Corporation. It is the case of the petitioners that the husband of the 1st petitioner was appointed as Driver in the respondentCorporation on 10-10-1994 and was discharging his duties as such. While so, he expired on 09-12-2018. Thereafter, the 1st petitioner submitted representations dated 18-12-2018 and 25-01-2019 to the respondent-Corporation to consider the case of the 2nd petitioner for appointment on compassionate grounds in terms of Circular dated 21.02.2017. But the
respondent-Corporation neither appointed the 2nd petitioner nor passed any orders on the said representations. Learned counsel appearing for the petitioners submits that though the husband of the 1st petitioner had expired long back, the respondents are not releasing his terminal benefits and not providing employment to the 2nd petitioner on compassionate grounds and not passing any orders on the representations submitted by the petitioners on 18.12.2018 & 25.01.2019.
Learned Standing Counsel appearing for the respondent-Corporation submits that the respondentCorporation would consider the said representations submitted by the petitioners and would pass appropriate orders.
Having considered the rival submissions made by the learned counsel on either side, this Court is of the view that ends of justice would be met if a direction is given to the respondent-Corporation to consider the representations of the petitioners.
Accordingly, the Writ Petition is disposed of directing the respondents to consider the representations dated 18.12.2018 and 25.01.2019 of the petitioners and pass appropriate orders thereon, in accordance with law, within a
period of six weeks from the date of receipt of a copy of this order. No costs.
Miscellaneous petitions, if any, pending shall stand closed.
