THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION No.1916 OF 2020 ORDER:

Heard the learned counsel for the petitioner as well as the learned Government Pleader for Municipal Administration and Urban Development appearing for the 1st respondent and the learned Standing Counsel appearing for respondents 2 to 4. 2.

The relief sought in the writ petition is questioning the action of the respondents in insisting for submission of NOC from the MRO for processing the building permission application of the petitioner under File No.3/C11/02549/2018 for Plot No.149, Survey No.66/2, Raidurg Nav Khalsa, Serilingampally Mandal, Ranga Reddy District, as arbitrary, illegal and violative of Articles 14, 21 and 300-A of the Constitution of India and in violation of the provisions of the Greater Hyderabad Municipal Corporation Act, 1955.

Learned counsel for the petitioner as well as the learned Government Pleader for Municipal Administration and Urban Development appearing for the 1st respondent and the learned Standing Counsel appearing for respondents 2 to 4, submit that the issue raised in the present writ petition is squarely covered by the order passed by this Court in W.P.No.6061 of 2019, dated 02.04.2019, and hence similar order may be passed. 4.

Having regard to the facts and circumstances of the case and the above submission of the learned counsel, and for the

PKR,J W.P.No.1916 of 2020 reasons alike recorded in the order, dated 02.04.2019, in W.P.No.6061 of 2019, the present Writ Petition is disposed of directing the 2nd respondent to consider the building permission application of the petitioner vide File No.3/C11/02549/2018, without insisting for 'NOC' from the revenue authorities, and pass appropriate orders in accordance with law, within a period of four (04) weeks from the date of receipt of a copy of this order. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
