HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.6538 OF 2013 ORDER:

In this petition filed under Section 482 Cr.P.C., the petitioner/A6 seeks to quash the proceedings against him in C.C.No.1535 of 2012 on the file of III Additional Chief Metropolitan Magistrate, Hyderabad.

When the matter came up for hearing, this Court called for information as to the present stage of C.C.No.1535 of 2012. Accordingly, the Metropolitan Sessions Judge, Hyderabad, in his letter in Dis.No.11930/MSJ/HYD/2018, dated 08.08.2018, submitted information to the effect that in view of the judgment of the Hon'ble Supreme Court of India in Dashrath Rupsingh Rathod v. State of Maharashtra and another1, the complaint was returned on 24.09.2014 for presentation before the proper court.

In that view, this criminal petition which was filed against C.C.No.456 of 2011 has become infructuous and it is accordingly dismissed as infructuous.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
