THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.16048 of 2017 ORDER:

This Writ Petition is filed challenging registration of FIR No.17 of 2017 on 14.03.2017 by the second respondent pursuant to a complaint lodged by the third respondent. This Court carefully perused the complaint lodged by the third respondent and a reading of the same discloses a prima facie case for registration of the crime. In such an event, this Court cannot interfere and hold that registration of the crime is bad in law. The other proceedings under the provisions of the Essential Commodities Act are different from the criminal proceedings initiated by the second respondent. In the circumstances, this Writ Petition is disposed of directing the second respondent to follow due process of law while investigating Crime No.17 of 2017 and, if necessary, comply with Section 41-A of Cr.P.C. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
