HONOURABLE SRI JUSTICE A. SHANKAR NARAYANA CIVIL REVISION PETITION No.2119 OF 2017 ORDER:

The present Civil Revision Petition is filed to direct the learned Junior Civil Judge, Chennur, to dispose of I.A. No.155 of 2016 in O.S. No.70 of 2016 filed by the petitioner - plaintiff.

2. His grievance is that instead of disposing of I.A. No.155 of 2016 by insisting for filing counter and to conduct enquiry, the learned Junior Civil Judge, Chennur, insisted for filing written statement by the respondent - defendant. One of the submissions is that the aforesaid interlocutory application filed seeking for injunction shall be disposed of within thirty (30) days.

3. The petitioner, who is the revision petitioner herein, is not certain whether any ex parte injunction order was granted. In case, any ex parte injunction order is granted, within thirty (30) days, the interlocutory application requires to be disposed of.

4. Be that as it may, since the aforesaid interlocutory application seeking urgent relief is filed and pending, it is desirable to direct the learned Junior Civil Judge, Chennur, to dispose of the same within one month from the date of receipt of a copy of the order.

5. Therefore, both the parties are directed to co-operate with the trial Court and the respondent - defendant herein is directed to file his counter within fifteen (15) days from today, and the learned Junior

Civil Judge, Chennur, to dispose of the interlocutory application within the period as directed above.

6. The Civil Revision Petition is accordingly disposed of. There shall be no order as to costs.

As a sequel thereto, Miscellaneous Petitions, if any, pending in the revision petition stand disposed of.
