HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.14643 of 2015 ORDER:

The Writ Petition was filed challenging the action of the respondents in trying to demolish the petitioner's buddy shop, Pushkal Fruit Juice, situated adjacent to Office of the Executive Engineer, Irrigation Department, Ramachandra Rao Road (Nakkal Road), Governorpet, Vijayawada, Krishna District, Andhra Pradesh. This Court, while ordering notice before admission on 14.05.2015, ordered that the petitioner shall not be dispossessed from the subject property except in accordance with law. Thereafter, the case was admitted on 12.06.2015 and interim order dated 14.05.2015 was extended until further orders.

It appears that notice was issued to the petitioner on 21.08.2015 asking to vacate the premises within fifteen days, failing which, appropriate action would be taken in accordance with law. However, without initiating further action, the petitioner - shop was demolished and he was evicted on 21.09.2015. While taking such an action, the respondents did not come to this Court and seek any orders. In view of the same, the petitioner filed C.C.No.1882 of 2015 and the same is being dealt with separately.

In view of the said development, no relief can be granted in the present Writ Petition but, liberty is given to the petitioner to take appropriate remedies available to him under law.

The Writ Petition is, accordingly, closed.
