The grievance of the petitioner is that he made representation dated 16-11-2016 to the 2nd respondent for according sanction under Section 197(1)(b) Cr.P.C. to initiate prosecution against the respondents 3 and 4 for falsely registering the subject property in favour of third parties, though the petitioner has right in the same. But the 2nd respondent has taken any action on the same. Aggrieved by the same, the present writ petition is filed.
Heard learned counsel for the petitioner.
Learned Assistant Government Pleader for Revenue submits that the respondent No.2 has no role to play in the matter and action can only be initiated under Section 83 (b) of the Registration Act (for short "the Act").
In view of the same, it is open for the petitioner to make necessary application under Sections 81 and 83 of the Act before respondent No.3 and on such application, respondent No.3 shall consider the same and pass appropriate orders in accordance with law and take action.
Accordingly, the writ petition is disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 18.04.2017 Nvl
