O R D E R
The case of the petitioner is that their father is the owner and pattadar of the subject land in an extent of Ac.0-12 gts. situate at Bhupalapally village, Jayashankar Bhupalpally District, and after his death, they succeeded to the property. Out of the said extent of Ac.0-12 gts., an extent of Ac.0-07 gts. was acquired and an award was passed. Now their grievance is that the respondents are erecting wall around the total extent of Ac.0-12 gts., though the acquisition was in respect of Ac.007 gts, without issuing any notice and paying compensation as per law in respect of construction being made in excess extent of Ac.0-05 gts. Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Land Acquisition.
Having regard to the facts and circumstances of the case and the limited grievance of the petitioners, writ petition is disposed of directing the respondents to issue notice to the petitioners, and after demarcation of the land, which is the subject matter of acquisition, shall proceed with the construction of compound wall in question, confining to the said extent.
Since the petitioners assert that construction work is in progress, the above direction shall be complied with by respondents 2 and 3, within a period of two weeks from today.
Interlocutory applications pending, if any, shall stand closed. No costs.
