THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL REVISION CASE No.48 of 2021 ORDER:

This Criminal Revision Case, under Sections 397 and 401 of code of Criminal Procedure, is filed aggrieved by the order, dated 08.12.2020, in Crl.M.P.No.199 of 2020 passed by the Judicial Magistrate of First Class, Nakrekal, in not fixing the duration of the passport to be issued in favour of the petitioner. 2.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor appearing for the respondent-State. Perused the record.

The petitioner herein is accused No.2 in C.C.No.677 of 2018. He has filed the aforesaid Miscellaneous Petition under Section 13 of the Passport Act, 1967 before the Court below to grant permission for renewal of his passport. The Court below, vide order, dated 08.12.2020, allowed said application. Operative portion of the said order reads as follows:

"In the result, this petition is allowed permitting the petitioner to get renewal of his passport. Further the petitioner/accused No.2 in event of travel to abroad in future, he shall inform the same to the Court and obtain necessary permission from the Court and directed to file undertaking to that effect. Further the petitioner/accused No.2 is directed to furnish the Photostat copy of the new passport (with all pages) before this Court and also furnish old passport number. Further, the petitioner is directed not to misuse the passport."

Though learned counsel for the petitioner filed this Criminal Revision Case aggrieved by the order passed by the Court below in not fixing the duration of renewal of passport to be issued in favour

of the petitioner viz., Rajender Reddy Kancharakuntla with file No.HY1072986147720 (with passport No.J1221396) for a period of ten years, he restricts his prayer seeking permission for renewal of passport of the petitioner for a period of five (5) years. 5.

Having regard to the same and considering the facts and circumstances of the case, the petitioner is permitted to renew his passport with file No.HY1072986147720 (with passport No.J1221396) for a period of three (3) years only. The impugned order shall remain unaltered in all other respects. 6.

To the extent indicated above, the Criminal Revision Case is disposed of.
