K.Ramanjinappa, v. Sri I.Balamunaiah,
THE HON'BLE SRI JUSTICE SANJAY KUMAR CONTEMPT CASE No.1180 OF 2016
O R D E R
This contempt case was instituted alleging willful disobedience to the order dated 23.02.2016 passed by this Court in W.P.No.739 of 2016. The said writ petition was disposed of taking note of the counter-affidavit averments to the effect that the candidature of three out of the six petitioners for selection under the Self Employment and Economic Support Scheme was found to be in order and accordingly directing the respondent authorities to consider their cases as per rules. It appears that the case of one out of the three writ petitioners has been considered and accepted. The other two are before this Court by way of this contempt case alleging disobedience. Heard Sri D.Sudarshan Reddy, learned counsel for the petitioners, Sri G.Seshadri, learned Standing Counsel for respondent No.1, and Sri P.
Subhash, learned Standing Counsel for the third respondent. The Mandal Parishad Development Officer, the first respondent, filed a counter-affidavit stating that the bank concerned was asked to consider the case of the first of the two petitioners herein. However, the bank communicated under letter dated 06.04.2016 that their cases could not be considered during the financial year 2016-17 as the loans had exceeded the targets for the year 2015-16. Further, insofar as the second petitioner is concerned, the bank found that he had applied for a power loom loan which was not found viable and his case was therefore not considered.
In the light of the aforestated facts, as the order passed by this Court has been duly complied with and upon considering the cases of the petitioners herein, their candidature was rejected, this Court finds no cause to exercise contempt jurisdiction.
The contempt case is accordingly closed. No order as to costs. ______________________ SANJAY KUMAR, J 27th AUGUST, 2016 PGS
