Heard counsel for petitioner, the Government Pleader for Higher Education appearing for 1st respondent and Sri A.Abhishek Reddy, Standing Counsel appearing for 2nd respondent.

Petitioner has assailed a Circular dt.08.01.2019, issued by the 2nd respondent stating as follows:

"All the Managements of affiliated Colleges of JNTUH, offering B.Tech Courses are hereby informed that the faculty-student ratio for grant of affiliation for the forthcoming A.Y.2019-20 will be calculated based on AICTE sanctioned intake only. However, if the faculty requirement is to be considered based on the admitted intake, the College has to apply for the same to the AICTE(in multiples of 60)."

This Circular is not shown to be issued under the provisions of any Statute and it is not known in exercise of what power such a circular is issued.

Counsel for the 2nd respondent states that the 2nd respondent would withdraw the said Circular.

In view of the said submissions, the cause in the Writ Petition no longer survives for adjudication and it is accordingly closed. No order as to costs.

Consequently, Miscellaneous Petitions pending if any, shall stand closed.
