O R D E R
The prayer of the petitioner in this case reads as under: 'For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate writ, order or direction, more in the nature of Mandamus, declare the inaction on the part of the respondents in taking action on the representation of the petitioner dated 9.11.2016 to protect the Government land in Sy.Nos. 741, 742, 743 of Malkajgiri village, Vallabhnagar Taluk, Medchal District (Old Ranga Reddy District) from encroaching/alienating the land other than the retainable land in Sy.No.743/P as illegal, arbitrary and in violation of Articles 21 and 300-A of the Constitution of India and consequently direct the respondents to take immediate appropriate action on the representation of the petitioner dated 9.11.
2016 and pass such other order or orders as are deemed fit and proper.' Perusal of the affidavit filed in support of the writ petition indicates that the petitioner's claim is that the 7th respondent is dealing with Government land without having any right or title and is cheating the public apart from looting away such Government property. It is therefore clear that the petitioner is purporting to act in public interest but for some reason he stopped short of stating so in his affidavit. The writ petition as framed is therefore not maintainable and is accordingly dismissed. This order shall however not preclude the petitioner from filing a proper case if he so chooses. Pending miscellaneous petitions shall also stand dismissed. No order as to costs.
