HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.3715 of 2015 ORDER :

This Criminal Petition is filed by the Petitioners/Accused Nos.1 to 9 under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.87 of 2013 on the file of Atreyapuram Police Station, East Godavari District for the offences punishable under Sections 498(A) r/w 34 I.P.C. and Sections 3 and 4 of the Dowry Prohibition Act.

2) Heard, the learned counsel for Petitioners/A-1 to A-9 and the 2nd respondent-State represented by the learned Public Prosecutor, before hearing for admission and before ordering notice to the 2nd respondent-defacto-complainant to the petition.

3) Undisputedly the crime is of 2013 and thereby no material to quash the proceedings from the application filed on 17.04.2015, but for to say from the material, the petitioners are entitled to submit to the investigating officer to consider the same, equally as part of investigation by form part of the record and as the petitioners are already on bail, they can approach the Magistrate to dispense with their personal appearance pending investigation.

4) With the above observations, the criminal petition is disposed of.
