HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.9393 OF 2017 ORDER:
This Criminal Petition, under Sections 437 and 439 of Cr.P.C., is filed by the petitioner/Accused No.6, seeking regular bail in Sessions Case No.110 of 2016, pending on the file of the Court of VIII Additional District and Sessions Judge, Chittoor (for short, 'the trial Court'). Heard the learned counsel for the petitioner/A-6, learned Public Prosecutor (A.P.) appearing for the respondent-State, and perused the record.
The earlier bail applications filed by the petitioner/A-6 viz., Criminal Petition No.10552 of 2016, 14870 of 2016 and 845 of 2017 were dismissed by this Court on 11.08.2016, 29.11.2016 and 13.03.2017 respectively. The bail application filed by the petitioner/A-6 before the Hon'ble Supreme Court was also dismissed. Learned counsel for the petitioner further submits that there are changed circumstances in filing the instant Petition i.e., the wife of the petitioner is suffering from paralysis and the trial Court in Crl.M.P. No.259 of 2017 granted him three days interim bail on 04.05.2017.
The attack of paralysis to the wife of petitioner/A-6 was already examined by this Court in the earlier bail application i.e., Criminal Petition No.845 of 2017 but the same was not considered. So it is evident from the record that the petitioner/A-6 is a perpetrator who was present at the scene of offence, arranged his own Maruthi cars to commit double murders in this case. He has also given his mobile number to Accused No.8 to video graph the offence, the motive for commission of the offence as per the prosecution case is that in the event of elimination of the sitting
Mayor, his wife would become Mayor, as the Mayor post was reserved for a woman belonging to BC-B category.
No changed circumstances are brought to the notice of this Court in filing the instant Petition and hence the Petition is devoid of merits and is liable to be dismissed.
In the result, the Criminal Petition is dismissed. In consequence, miscellaneous petitions, if any, pending in this Petition shall also stand dismissed.
