Heard.
The petitioner, who claims to be the owner of the land admeasuring 500 sq. yards in Sy.Nos.36 and 42 situated at Mangalpally Village, Ibrahimpatan Mandal, Ranga Reddy District, alleges interference by the 4th respondent. He states that his vendor was granted pattadar pass books and his name was also entered in the revenue records and he has purchased the private property belonging to his vendor and therefore, the Government is no way concerned with the said land.
Learned Government Pleader has received instructions, which state that the land admeasuring Ac.0-08 cents in Sy.No.41 situated at Mangalpally Village, is classified as 'Kabarstan', which is Muslims grave yard. On the representation of Muslims, the Mandal Surveyor has surveyed the area and fixed the boundaries in respect of Sy.No.41. On survey, it is revealed that the petitioner has encroached some extent of graveyard land and therefore, the stones erected in the graveyard land have been removed. The 4th respondent specifically states that he has not entered into the land bearing Sy.Nos.36 and 42 of Mangalpally Village and, therefore, the allegation of trespass into the petitioner's land is totally incorrect. It is evident from the above that the petitioner's claim is to the extent of the land purchased by him, which is stated to be located in Sy.Nos.36 and 42 and the 4th respondent has taken action only with regard to Sy.No.41, which is Muslims graveyard and he has not entered into the land in Sy.Nos.36 and 42.
As the allegation of trespass is not being established, no further orders are necessary in this writ petition.
Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand
closed.
