M/S Kakatiya Cement Sugar And Industries Ltd., v. The State Of Andhra Pradesh
HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN AND HON'BLE MS. JUSTICE J. UMADEVI Writ Petition No.1214 of 2017 Order: (per V.Ramasubramanian, J.) Heard the learned Additional Advocate General appearing for the respondents.
2. This writ petition challenges the enhancement of transit fee by the Government. But it appears that the Government recently passed an order in G.O.Ms.No.11, Environment, Forests, Science & Technology (Section-II) Department, dated 30-01-2017, keeping the order issued under G.O.Ms.No.115, EFS&T (Section-II) Department, dated 27-12-2016 in abeyance. It appears that the Government is considering the representations of the concerned parties.
3. Therefore, the writ petition is dismissed for the present. If a fresh order is passed either restoring G.O.Ms.No.115, dated 27-122016 or imposing a fresh fee, it will be open to the petitioner to come up again. No costs. The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
