Learned counsel for petitioner submits that the suit out of which this Revision arises has been decreed, that it was questioned in first Appeal, which was dismissed and that a Second Appeal is now pending on the file of this Court and consequently this Revision has become infructuous. Learned counsel for petitioner seeks to withdraw this Revision with liberty to urge the points raised herein in the Second Appeal filed in this Court arising out of O.S.No.257 of 2006 on the file of the Senior Civil Judge, Vikarabad. Granting liberty as sought, this Revision is dismissed as infructuous. No costs.

As a sequel, miscellaneous petitions pending if any, shall stand disposed of.
