THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.11558; 11750; 10977 and 10981 of 2017 COMMON ORDER:
These Writ Petitions are filed by the petitioners questioning the proceedings dated 10.03.2017, issued by the 5th respondentSuperintendent, Prohibition and Excise, Nalgonda. In all these cases though the learned counsel for the petitioner disputes that their wine shops are located within 500 mtrs., of the National Highway / State Highway, the said aspect is not required to be decided presently in the light of the clarificatory order of the Supreme Court dated 31.03.2017 in The State of Tamilnadu v K. Balu and another1, wherein the Supreme Court had allowed the existing licensees to continue their business till 30.09.2017.
In the light of the same, the Writ Petitions are closed, leaving the issue 'whether the shops of the petitioners fall within the 500 mtrs., of State Highway or National Highway' open, with a direction that the petitioners shall be allowed upto 30.09.2017. Consequently, the Miscellaneous Petitions, if any pending, shall stand closed. No order as to costs.
