THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9839 of 2015 ORDER:

This petition is filed to quash the proceedings against the petitioners in FIR No.320 of 2015 on the file of Amalapuram Town Police Station, Amalapuram, East Godavari District for the offences under Sections 341, 427, 506 r/w 34 IPC.

As seen from the complaint, specific allegations are levelled against the petitioners herein. This Court is of the view that all the points now raised by the petitioners can be pleaded before the trial Court for its appreciation since this Court cannot decide all those disputed questions of fact. At this stage, no prima facie case is made out by the petitioners to quash the impugned proceedings. Hence this Court is not inclined to interfere with the impugned proceedings. However, the police are directed to complete the investigation without arresting the petitioners herein and file a final report, if any.

The petition is disposed of accordingly.
