HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.2073 of 2019 ORDER:

The grievance of the petitioners is that the Sub-Registrar, Cherial, Siddipet District, is not receiving the sale deeds presented by them for registration relating to their land in Sy.No.197 of Tadoor Village, Cherial Mandal, Siddipet District. Learned Assistant Government Pleader for Revenue, State of Telangana, would seek time to get instructions in the matter but this Court is of the opinion that no adjudication is warranted at this stage as the registration authorities are yet to take action in relation to the documents presented by the petitioners. The Writ Petition is accordingly disposed of permitting the petitioners to present their documents for registration in relation to the subject land.

In the event the Sub-Registrar, Cherial, Siddipet District, finds the document presented to be in order and in full compliance with the requirements of the Registration Act, 1908 and the Indian Stamp Act, 1899, the document shall be processed, registered and released in accordance with the due procedure. If, for any reason, the Sub-Registrar opines that the document cannot be registered, he shall pass a reasoned order of refusal under Section 76 of the Registration Act, 1908 and communicate the same to the petitioners.

Miscellaneous Petitions pending in this Writ Petition shall stand dismissed. No order as to costs.
