THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.17225 of 2017 ORDER :

The grievance of the writ petitioner is that without issuing any notice, the respondents are straightaway trying to demolish the subject properties.

Learned counsel for the petitioner also submits that the petitioner has applied for permission and made constructions under deemed permission.

Learned Standing Counsel for the Greater Hyderabad Municipal Corporation submits that notice dated 28-04-2017 is issued under Sections 452(1) and 461(1) of Hyderabad Municipal Corporation Act (for short "the Act") and as well as order under Section 452(2) of the Act is also passed.

Both counsel submit that this writ petition can be disposed of granting liberty to the petitioner to file explanation to the notice issued under Sections 452(1) and 461(1) of the Act.

In view of the same, it is open for the petitioner to submit explanation to the notice dated 28-04-2017 within a period of two weeks from today and on submission of such explanation, the 3rd respondent is directed to consider the same and pass orders after affording opportunity of hearing to the petitioner. Till such time, there shall be stay of demolition of subject properties. If the petitioner does not file

explanation within the stipulated time, it is open for the respondents to take appropriate action in accordance with law.

Subject to the above direction, this writ petition is disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed. No order as to costs. _________________________ A. RAJASHEKER REDDY, J 25.05.2017.
