HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON Nos.24384 And 13421 of 2012 COMMON ORDER:
WP.No.24384 of 2012 is filed to declare the action of the respondents in not processing the applications made by the members of the petitioner-association for regularization of the land in their occupation in Sy.No.182, T.S.No.3, Bharathnagar, Musheerabad in terms of G.O.Ms.No.166, dated 16-02-2008.
WP.No.13421of 2012 is filed to declare the action of the respondents in attempting to dispossess the members of the petitioner-society from their huts situated in Sy.No.182, T.S.No.3, Bharathnagar, Musheerabad, Hyderabad as illegal and arbitrary.
It is stated by the learned counsel appearing for the petitioner-association, the 5th respondent as well as the learned Government Pleader for Revenue that G.O.Ms.No.166, dated 16-02-2008 was withdrawn by the Government in PIL.No.517 of 2013. WP.No.24384 of 2012 is filed as the respondents are not processing the applications of the members of the petitioner-association under G.O.Ms.No.166. G.O.Ms.Nos. 257 and 258 are nothing but extending the time fixed under G.O.Ms.No.166. In view of the same, no relief can be granted in terms of G.O.Ms.No.166.
Though, the learned counsel for the petitionerassociation stated that the members of the petitionerassociation made applications under G.O.Ms.Nos.58 and 59 dated 30-12-2014, the learned Assistant Government Pleader for Revenue says cut-off date is fixed in the said G.Os. Since, it is also stated by the learned counsel for the petitioner that the members of the petitioner-association have made applications on 17-01-2015, the competent authority shall dispose of the same, if the same are filed within time, in accordance with G.O.Ms.Nos.58 and 59 within a period of two months from the date of receipt of a copy of this order.
With the above direction, these writ petitions are disposed of.
Till then, status-quo granted earlier i.e. on 07-08-2012 in WP.No.24384 of 2012 shall continue. If applications are not filed within cut-off date fixed in G.O.Ms.Nos.58 and 59, dated 30-12-2014, it is open for the respondent-authority to take appropriate action in accordance with law. As a sequel to the disposal of these petitions, miscellaneous petitions, if any, pending shall stand closed.
