HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO M.A.C.M.A. No.330 of 2010 JUDGMENT:

The injured claimant maintained O.P. No.2662 of 2006 on the file of Motor Accident Claims Tribunal-cum-III Additional Chief Judge, City Civil Court, Hyderabad (fort short 'the Tribunal') under Section 166 of the Motor Vehicles Act (For short 'the Act') for compensation of Rs.5,00,000/ - against the owner and insurer of the auto bearing No.AP 22 V 0606. From the contest of insurer, the Tribunal granted compensation of Rs.2,25,000/ - with interest at 7.5% per annum on 06.10.2009. Impugning the same, the claimant maintained the present appeal.

Heard both sides and perused the material on record. 3.

A perusal of the record shows that the petitioner is working as Project Manager in M/ s.Keerthi Constructions and there is no evidence to show that due to the accident, caused any disability including from the so-called removal of skin, any loss of earnings, promotion prospectus but for any functional disability even 35% permanent disability to the limb. The Tribunal by considering the same awarded Rs.75,000/ -

towards blunt injury to abdomen, injury to left leg besides pain and sufferance, besides to it, an amount of Rs.1,00,000/ - awarded towards medical bills for the skin removal and an amount of Rs.50,000/ - awarded under the head of loss of earnings, in all it comes, to Rs.2,25,000/ -. This Court feels it just to enhance the compensation from Rs.2,25,000/ - to Rs.2,50,000/ -.

Accordingly and in the result, the appeal is partly allowed by enhancing the compensation from Rs.2,25,000/ - (Rupees two lakhs twenty five thousand only) to Rs.2,50,000/ - (Rupees two lakhs fifty thousand only). In other respects the award of the Tribunal holds good. No order as to costs. 5.

Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
