HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.1826 OF 2017 ORDER:

The case of the petitioner is that he is the owner of lands to an extent of Ac.0-13 cents in Sy.No.177-8, Ac.0-02 cents in Sy.No.177-10 and Ac.0-05 cents in Sy.No.177-15 situated at Kesavaram Village, Kota Mandal, SPSR Nellore District.

He also purchased lands from Chittati Dasaradharamaiah and Chittati Balakrishnaiah in Sy.No.177-9 an extent of Ac.0-16 cents and Sy.No.177-9B an extent of Ac.0-16 cents total an extent of Ac.0-32 cents of said village. The respondent No.4 along with the respondent No.3 came to the fields of the petitioner and conducted survey and that the petitioner made several requests to the respondents 2 and 3 not to transfer the subject lands in the name of the respondent No.4. The petitioner apprehends that the lands are going to be transferred in favour of the respondent No.4. The petitioner has alternative effective remedy for approaching civil Court and this Court cannot go into disputed questions of fact and declare the rights of the petitioner in the writ petition. On mere apprehension, the petitioner filed this writ petition. As and when any such proceedings are issued, it is always open to the petitioner to challenge the same.

In view of the above, this writ petition is devoid of merits and the same is accordingly dismissed. As a sequel to the

disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
