This Criminal Petition is filed under Sections 437 and 439 ofCode of Criminal Procedure' 1973 (for short "Cr'P C") seeking regular bail to the petitioner/ accused in Crime.No.43Tof2023,onthefrleofAsifnagarPoliceStation, punishable under Hyderabad, registered for the offences Sections 498-A and 306 of IPC'

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record'

The petitioner is the sole accused' The allegation against this petitioner is that he was married to the deceased and he was harassing her physically and mentally On the I day she committed suicide' it is alleged that this petitioner I started recording the alleged suicide attempt o[ his wife on phone and ultimately she died by handing herself' Learned counsel for the petitloner would submit that since the deceased was harassing the petltloner and

threatening him that she would commit suicide, by way of caution, the petitioner had recorded the alleged threats of the deceased.

5. On the other hand, learned Additional Public Prosecutor would submit that the petitioner has recorded suicide of the deceased and in fact the petitioner abetted the deceased to commit suicide.

Since the case is under investigation, this Court is not inclined to grant the relief of regular bail at this stage 7.

Accordingly, this Criminal Petition is dismissed. However, the petitioner is at liberty to renew his application for regular bail before the lower Court under changed circumstances. Miscellaneous applications, pending if any, shall stand closed.
