HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.17043 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies for respondents.

2. This Writ Petition was filed by the owner of the vehicle challenging the order passed by the second respondent on the application filed by him for releasing of the vehicle which is involved in the proceedings under Section 6-A of the Essential Commodities Act.

3. The learned counsel for the petitioner submits that he is ready to furnish bank guarantee or security for the value of the seized stock which to the tune of Rs.1,77,534.39 ps., but this Court is not impressed with the said argument. However, the second respondent is directed to release the vehicle in question on petitioner furnishing bank guarantee for a value of Rs.5,50,000/- being half of the estimated value of the seized vehicle. The order of the second respondent dated 10.06.2015 is modified accordingly.

4. The Writ Petition is, accordingly, disposed of. No order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. _______________________________ A. RAMALINGESWARA RAO, J Date: 19.06.2015 TJMR
