THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.9174 of 2016 ORDER:

This petition under Section 482 Cr.P.C., is filed by the petitioners/A.1 & A.2 seeking to quash the proceedings in Crime No.113 of 2016 of Charminar Police Station, Hyderabad, registered for the offences punishable under Sections 354-D and 324 IPC against them.

2. The defacto complainant filed a complaint against the petitioners alleging that the 1st petitioner who is her brother-in-law, teased her by passing whistle and touched her body parts intentionally. When the de facto complainant told her husband about the same and when he went to ask the petitioners, they beat him indiscriminately. It is also alleged that the petitioners also beat her father-in-law and brother-in-law and threatened them. Hence, the complaint

3. Heard learned counsel for the petitioners/A.1 & A.2 and learned Additional Public Prosecutor representing the State.

4. Learned counsel for the petitioners submit that the petitioners obtained bail in the matter. He further submits that at the time when the petitioners were remanded to judicial custody, the learned Magistrate has directed them to appear before the Court. But till now the charge sheet is not filed and the learned Magistrate is insisting the petitioners to appear till the charge sheet is filed.

5. In that view of the matter, the Criminal Petition is disposed of directing the learned Magistrate not to insist for the presence of petitioners/A.1 & A.2 till charge sheet is filed and summons are issued. Learned Magistrate shall obtain bonds from the petitioners to appear on being summoned.

6. With the above direction, the Criminal Petition is disposed of.

7. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
