THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4891 of 2015 ORDER:

The petitioners, who are accused Nos.1 to 10 in Crime No.36 of 2015 of Chippagiri Police Station, Kurnool District, registered for the offences punishable under Sections 147, 148, 323, 341, 355, 384 and 506 read with 34 IPC and Section 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act (for short 'the Act'), filed this petition under Section 438 of Cr.P.C., seeking anticipatory bail.

Heard and perused the material available on record. The allegations against the petitioners are that when the de facto complainant attended for lunch, invited by one of his friends in the village, the petitioners, who also attended for the same, abused him in the name of his caste since he was also sitting along with them, and thereafter, when the de facto complainant and his mother were going on a motor cycle to the vegetable market, the petitioners stopped them and took the de facto complainant to their house and beat him indiscriminately.

A reading of the material available on record would disclose serious allegations against the petitioners.

Considering the seriousness of the allegations made against the petitioners and since there is a bar for grant of bail for the offence under Section 3 (1) (x) of the Act, this Court is not inclined to grant anticipatory bail to the petitioners.

Accordingly, the Criminal Petition is dismissed. ______________ RAJA ELANGO, J June 12, 2015.
