HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.2093 of 2019 ORDER:

This writ petition is filed seeking a Writ of Mandamus declaring the action of respondents in not reinstating the petitioner into service as Chainman on daily wage basis as illegal, arbitrary and unconstitutional and sought a consequential direction to direct the respondents to reinstate the petitioner into service as Chainman on daily wage basis.

Heard Mr.S.Chandra Sekhar, learned counsel for petitioner and the learned Government Pleader for Services-I. It has been contended by the petitioner that he was appointed as Chainman during the year 1999 on daily wage basis and he was continued till 2006. Thereafter, without assigning any reasons, the respondents have disengaged the services of the petitioner. Therefore, the petitioner made a representation to the respondents on 29.12.2018 to re-engage him as Chainman on daily wage basis.

The grievance of the petitioner is that the respondents are not passing any orders on the representation submitted by the petitioner nor re-engaging the petitioner as Chainman on daily wage basis.

Learned counsel for petitioner contends that appropriate orders be passed in the writ petition directing the respondents to consider the representation submitted by the petitioner on 29.12.2018 and pass appropriate orders.

Learned Government Pleader appearing for respondents has contended that the representation of the petitioner will be considered and appropriate orders would be passed in accordance with law.

This Court, having considered the submissions made by the learned counsel for the parties, is of the considered view that the writ petition can be disposed of directing the respondents to consider the representation submitted by the petitioner on 29.12.2018 and pass appropriate orders in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.
