THE HON'BLE SRI JUSTICE DILIP B.BHOSALE AND THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT APPEAL No. 2439 of 2005 JUDGMENT: (per the Hon'ble Sri Justice Dilip B.Bhosale) None appears for the appellant. Mr.N.Ashwani Kumar, learned counsel, represents respondent Nos.1 to 3. The appellant in the writ petition had challenged the Office Memorandum, dated 20.03.2003, by which respondent Nos.1 to 3 imposed punishment in the form of compulsory retirement. At the time of the order, dated 20.03.2003, six years service was left. During the pendency of the writ petition and this appeal, no interim relief was granted. In view thereof, it appears that the appellant has lost interest in prosecuting this appeal further and hence, nobody is coming forward to work it out on merits. Hence, we are constrained to dismiss the writ appeal for non-prosecution. Order accordingly.
