HON'BLE SRI JUSTICE SURESH KUMAR KAIT A N D HON'BLE DR. JUSTICE SHAMEEM AKTHER O R D E R : ( Oral, Per the Hon'ble Sri Justice Suresh Kumar Kait ) Vide the present the petitioner has challenged the order dated 10/07/2017 passed by the A.P. Administrative Tribunal, Hyderabad, in O.A.No.1852 of 2017, whereby the O.A. filed by the petitioner has been allowed by directing the respondents to allow the petitioner to participate in the examination which is to be held on 15/07/2017 and 16/07/2017.
2. It is not in dispute that screening test was held on 26/02/2017, pursuant to Notification No. 18/2016, dated 08/11/2016. The total vacancies to be filled up is 982. Total 6.5 lakhs candidates applied for the said posts, however, 4.5 lakhs appeared. The grievance of the petitioner before the Tribunal was that only 49,100 candidates were called and the petitioner was also having 74.49 marks, however, not called. The learned Tribunal after considering the rival contentions
allowed the O.A. filed by the petitioner directing the respondents to permit the petitioner for main examination.
3. The case of the petitioner herein is that the examination should be postponed because the petitioner could not prepare for the said examination and it will cause great injustice to the petitioner.
4. It is not in dispute that one batch of similarly situated candidates approached the Tribunal vide O.A.No. 963 of 2017 and the same was allowed vide order dated 28/04/2017 by following the order dated 03/09/2011 passed by this Court in WP.No. 26163 of 2011. The petitioner belatedly approached the Tribunal, however, the Tribunal permitted the petitioner to participate in the examination. When 49,100 candidates are appearing for the main examination, this Court cannot postpone the written examination/main examination scheduled to be held on 15/7/2017 and 16/07/2017 to a reasonable period of four to six weeks or stay the whole selection process pertaining to Notification No.18/2016.
5. Finding no merit in this writ petition, the same is accordingly dismissed at the stage of admission. There shall be no order as to costs.
6. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
