Heard the learned counsel for the petitioner and the learned Public Prosecutor.

2. The present Criminal Petition came to be filed under Section 439(1)(b) read with 482 of the Code of Criminal Procedure, 1973, by the petitioner/A.1 seeking modification of the order dated 22.01.2016 passed by the I Additional Judicial Magistrate of First Class at Jagtial in Crl.M.P.No.8 of 2016 in Crime No.8 of 2016 of Jagtial Town Police Station, Karimnagar District, registered for the offences punishable under Section 498-A IPC and Section 4 of Dowry Prohibition Act, 1961, wherein and whereby, the Court below while ordering release of the petitioner, directed him to deposit the passport before the Court.

3. Having regard to the fact that the crime was registered only in the month of January, 2016 and as the investigation is still under progress, I am not inclined to consider the request of the petitioner at this stage.

4. Accordingly, the Criminal Petition is dismissed. However, it is always open to the petitioner to approach the trial Court to renew his request, in which event the same shall be dealt with in accordance with law.
