THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION Nos.6646 & 6684 OF 2017 COMMON ORDER:

These two writ petitions are filed seeking a direction to the 2nd respondent to open the price bids for the tender in 'e' NIT No.55/Core Net/MD, APRDC/2016-17, dated 14-12-2016 and NIT No.50(1)/Core Network/MD, APRDC/2016-17, dated 28.11.2016 respectively, forthwith. When both the matters were taken up for hearing on 06.03.2017, the learned Government Pleader for Roads and Buildings, on instructions, submitted that there were certain clarifications determined sought by the department and in that connection, the department had addressed a letter on 01.03.2017 to their counter-parts in Tamil Nadu in which State the petitioners claimed to have executed certain works. They are yet to receive clarifications and a copy of the letter was also marked to the petitioners and the matters were adjourned to today.

Considering the submission made on behalf of the respondents, the matters were directed to be listed to today. Today, the learned counsel for the petitioners submits that a copy of the letter dated 01.03.2017, discloses that the respondents are required only three documents viz., 1) Genuineness of experience certificates issued by the department, 2) Certificates of ongoing works duly indicating the value of work done and balance value of work to be done uploaded value for the works shown in Statement IV(A) and 3) Certificates, if the bidder has participated (Or) not participated in any tender of the department. As a matter of fact, these documents were already submitted and also the Superintendent Engineer, Roads and Bridges, Greater Chennai Corporation, had also sent the necessary particulars sought by the respondents.

Learned counsel also submits that even the said documents were uploaded in the website of the department.

Government Pleader that certain documents submitted by the petitioners were not in English and they are in Tamil and requested the petitioners to submit the same in English version duly authenticated. Petitioners assert that the authenticated English version documents have already been submitted.

Considering the respective submissions of the parties and inasmuch as new clarifications which are sought by the respondent department have been made available to the petitioners, the respondents shall take into consideration of the same and process the tender, in accordance with the procedure notified, within a period of two weeks from the date of receipt of copy of the order. With the above observations, both the writ petitions are disposed of. No order as to costs.

Miscellaneous petitions, if any, pending in these writ petitions shall stand closed.
