HONOURABLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No. 553 of 2019 O R D E R :

Impugning the First Information Report in Crime No.12 of 2019 by the Station House Officer, Kulcharam Police Station, Medak district, for an offence punishable under section 188 of I.P.C., the petitioners/A-1 to A-10 filed this quash petition.

2. Heard the learned counsel for the petitioners/A-1 to A-10 and the learned Public Prosecutor representing the first respondent-State and also the defacto complainant/constable - second respondent and perused the FIR in Crime No. 12 of 2019 of Kulcharam Police Station, Medak district, registered for an offence punishable under section 188 of IPC and the grounds of quash petition. Un-disputably from the very reading of section 195[1] Cr.P.C., there is a bar to register a crime but for a private complaint.

4. Having regard to the above, the crime proceedings are quashed by left open such remedy to maintain private complaint procedure if at all invoking section 195 Cr.P.C.

5. In the result, this Criminal Petition is allowed.
