THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.12484 of 2015 ORDER:

This petition is filed under Section 482 Cr.P.C. to quash the proceedings in C.C.No.177 of 2011 on the file of the V Additional Judicial Magistrate of First Class, Nellore, S.P.S.R. Nellore District.

The learned counsel for the petitioners seeks permission of this Court to permit the petitioners to withdraw the criminal petition with a liberty to avail the remedies available to them under law including filing of the discharge petition, if charges are already not framed as well as to file a petition under Rule 37 of the Criminal Rules of Practice.

Permission is granted.

Hence, the Criminal Petition is dismissed as withdrawn as prayed for. Consequently, Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand closed.
