THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE DR JUSTICE SHAMEEM AKTHER Writ Appeal No.314 of 2017 JUDGMENT: {Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan} After arguing for some time, Sri Y.V.Ravi Prasad, learned Senior Counsel appearing on behalf of the respondent-writ petitioners, would submit that since the order under appeal was passed on grounds, other than those contended before the Learned Single Judge, this Court may set aside the order under appeal and restore the W.P.M.P. to file. In view of the submission of the learned Senior Counsel, it is unnecessary for us to examine the contentions of Sri S.Lakshminarayana Reddy, learned Standing Counsel for GVMC on merits. The order under appeal is, accordingly, set aside.

W.P.M.P.No.3186 of 2017 in W.P.No.2705 of 2017 is restored to file. The appellants herein shall file their counter affidavit within ten days from today. It is open to the respondent-writ petitioners herein to request the Learned Single Judge to take up W.P.M.P. any day after ten days. The Writ Appeal is disposed of accordingly. Miscellaneous Petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
