THE HON'BLE SRI JUSTI CE T.VI NOD KUMAR WRI T PETI TI ON No.2040 of 2020 ORDER:

This writ petition is filed to declare the action of respondent No.3 in summoning the petitioner to the police station without there being any crime registered against the petitioner and interfering in civil dispute as being illegal and violative of Articles 14 and 21 of the Constitution of India.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home for respondents 1 to 3. 3.

Learned Assistant Government Pleader for Home, on written instructions dated 31.01.2020 a copy of which is placed on record, submits that one Naresh Kumar Agarwal, the authorized partner of M/s.Gopal Trading Company, Mukthiyargunj, Hyderabd, gave a petition to the Station House Officer, Afzalgunj on 25.12.2019 stating that one Kiran Bhati and others approached him and requested for supply of food grains on credit and assured him that regular payments would be made for such supplies and have taken food grains for which they are liable to pay an amount of Rs.35,26,700/-, but did not pay the amount, as such, cheated him. On receipt of the above petition, the authorities made GD entry and conducted enquiry and during the course of enquiry called both the parties and since the issue relates to civil dispute between the complainant and the petitioner, the petition was closed as civil in nature on 22.01.2020. It is further stated that except causing enquiry on the said petition, the respondent police never interfered in the civil dispute of the petitioner at any point of time.

In view of the above submissions made by the learned Assistant Government Pleader for Home on behalf of the respondent police authorities, no further orders are need be passed in the writ petition. 5.

Accordingly, the writ petition is closed. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
