Heard the learned counsel for the petitioner, and the learned Government Pleader for Civil Supplies (A.P).
The authorization of the petitioner, who is a fair price shop dealer of shop No.20 of Duddukur Village, Inkollu Mandal, Prakasam District was suspended by 3rd respondent-Revenue Divisional Officer, Ongole Division, Ongole, Prakasam District by proceedings dated 31.7.2014 on the ground that the petitioner got married and has been residing in some other village. The contention of learned counsel for the petitioner is that the petitioner after marriage has been residing in the same village along with her husband and therefore her authorization ought not to have been suspended. The petitioner in support of her claim filed certain documents including that of ration card. However, this Court, in any event, cannot evaluate the evidence in exercise of its jurisdiction under Article 226 of the Constitution of India.
Therefore, this writ petition is disposed of
directing the 3rd respondent-Revenue Divisional Officer, Ongole Division, Ongole, Prakasam District to conduct enquiry and pass final orders within a period of eight weeks from today notwithstanding pendency of the appeal before the 2nd respondentJoint Collector, Ongole, Prakasam District.
