HON'BLE SRI JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT APPEAL No. 134 OF 2015 P.C: (per the Hon'ble Sri Justice Dilip B. Bhosale) Heard learned counsel for the parties.
The appellants have filed additional affidavit as per our earlier order dated 18-03-2015 and placed on record a list of cases in which the dependants of deceased - employees were paid monetary benefit. They have placed on record a notification dated 10-02-2015, whereby the Corporation has taken a policy decision in respect of restoration of bread winner scheme. In this scheme, the Corporation has made it very clear that the dependants of the deceased - employees who have availed the benefit of additional monetary benefit shall not be eligible to consider their claim for employment as per the bread winner scheme. In view of the affidavit and the notification dated 10-02-2015, learned counsel for the respondents prays for withdrawal of the writ petition, with liberty to the respondents to file fresh petition challenging the said notification.
Learned counsel for the appellants has no objection for allowing the respondents to withdraw the writ petition, with liberty as prayed. Hence, we dispose of this writ appeal by the following order: "Writ Petition No.21743 of 2014 is disposed of as withdrawn, with liberty to the respondents i.e., the petitioners in the writ petition to file fresh writ petition for similar relief challenging the subsequent notification dated 10-02-2015. In view thereof, the order impugned in the present writ appeal is set aside. All contentions of the parties on merits are kept open."
