THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.12517 of 2015 ORDER:

This Criminal Petition is filed by the petitioner-A1 under Section 438 Cr.P.C. seeking anticipatory bail in CC No.36 of 2010 on the file of Additional Judicial Magistrate of First Class, Razole, East Godavari District, for the offences punishable under Sections 498-A r/w.34 IPC.

Heard and perused the material available on record. The marriage between the de facto complainant and the petitioner was performed in the year 1992. They blessed with two female children. The allegation against the petitioner is that he along with his family members used to harass the de facto complainant demanding additional dowry. Therefore, the de facto complainant filed a private complaint and the same was referred to the police. After completion of investigation, the police filed charge sheet, showing the petitioner as absconding. Hence, the Court below issued NBWs against the petitioner. Learned counsel for the petitioner submitted that the petitioner went to Dubai for his job purpose and now he intends to come to India and he is ready to face the trial.

Considering the facts and circumstances of the case and in view of the submissions of the learned counsel for the petitioner, this Court is inclined to pass the following order:

The petitioner-A1 is directed to appear before the Court concerned and file a petition to recall the warrant issued against him and on such filing of a petition, the trial Court is directed to recall the warrant on the same day on his execution of bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety for a like sum and further the petitioner is directed to appear before the trial Court regularly. Accordingly, the Criminal Petition is disposed of. ______________ RAJA ELANGO, J December 04, 2015.
