THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.23584 of 2012 ORDER:

Heard Sri Raja Reddy Koneti for petitioner, Sri Cheemalapati Ravi for the 1st respondent and the Assistant Government Pleader (Home) for the 2nd respondent.

The petitioner prays for Mandamus declaring the action of respondents in demolishing shop/ house bearing No.3-53 at Gurazala Town, Guntur District, as illegal and contrary to the principles of natural justice.

The petitioner also prays for damages for the alleged demolition of the subject matter of the writ petition.

The 1st respondent filed counter affidavit and explained the circumstances under which action was sought to be initiated against the petitioner.

At the time of hearing, learned counsel appearing for parties admit the possession of petitioner even as on date. That being the case, this Court is of the view that the respondents shall not dispossess the petitioner from the subject matter of the writ petition or demolish the premises except in accordance with law.

The writ petition is accordingly disposed of as indicated above. No order as to costs.
