THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.4069 OF 2004 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the proceedings issued by the first respondent in Rc.No.G2/46605/2001-85 dated 31.08.2001 in so far as the salaries and other benefits of Sri B.Krishna Murthy, J.A., who is duly authorized to exercise the powers as Executive Officer should be borne by the institution for which he is authorised to manage where the financial position of such institution does not permit such commitment, the same should be paid from the institution where they have been paid prior to such authorization continue to get his salary and such other benefits from Sri Mahankalamma Temple, Issapalem, Guntur District, where he has been working as employee is concerned and consequential proceedings vide L.Dis No.G2/35201/2002, dated 30.07.

2002 thereon issued by the first respondent herein as illegal, arbitrary and unconstitutional and contrary to Section 57(2) of A.P. Endowments Act, 1987 and direct the third respondent not to draw and to pay the arrears salary to the fourth respondent from the petitioner's temple.

The learned counsel for the petitioner submitted that the purpose of filing the writ petition has become infructuous. In view of the submission made by the learned counsel for the petitioner, the Writ Petition is dismissed as infructuous. No costs.

Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
