THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE T.AMARNATH GOUD WRI T PETI TI ON NO.1760 of 2018 ORDER: (per SK,J) There was no representation for the petitioner when this matter was taken up for hearing on 12.06.2018. It was accordingly directed to be listed under the caption 'For Dismissal' on 13.06.2018. Today, though the matter appears under the caption 'For Dismissal', an adjournment is sought when the case is taken up for hearing.

We are not inclined to grant an adjournment in the matter which is posted 'For Dismissal' owing to lack of representation on behalf of the petitioner and its learned counsel. That apart, Smt.V.Dyumani, learned counsel for M/s.Pridhvi Asset Reconstruction and Securitisation Company Limited, Hyderabad, the third respondent herein, would inform this Court that the complaint of the petitioner before this Court was that the Debts Recovery Tribunal, Visakhapatnam, did not grant sufficient time to it to make the payment but despite this Court extending time to do so vide order dated 12.04.2018, the petitioner did not make any deposit. She would further inform this Court that the sale was confirmed in favour of the successful bidder who deposited the entire sale consideration amount.

Given the aforestated facts and the negligence on the part of the petitioner and its learned counsel in prosecuting this matter, the writ petition is dismissed for default.

Interim order dated 24.01.2018 shall stand vacated. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
