Mohammad Raheemuddin v. M/S.Shriram City Union Finance Limited.
THE HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN THE HON'BLE SRI JUSTICE N. BALAYOGI CIVIL REVISION PETITION No. 3681 of 2017 ORDER: (Per VRS,J) The petitioners have come up with the above revision making a very strange prayer, challenging the return of the application for issue of certified copies.
2.
Heard Mr. D. Madhava Rao, learned counsel for the petitioners. 3.
We doubt whether the revisional jurisdiction under Article 227 of the Constitution should be reduced to such a level as to supervise the section dealing with applications for issue of certified copies. 4.
Be that as it may, the petitioners seem to have suffered an arbitration award and the award holder has filed an execution petition before the Principal District Court, Karimnagar. After receipt of notices in the execution proceedings, the petitioners seem to have applied for certified copies of the original documents filed before the arbitrator. The executing Court returned the copy application, since normally, suit documents or documents marked before the arbitrator will not be filed along with the execution petition. Challenging the return made by the Superintendent of the C.C. Section, the jurisdiction of the Division Bench of this Court under Article 227 is invoked by the petitioners.
5.
The revision is not entertainable for the simple reason that even in an execution petition filed for executing a decree passed by civil Court, no one can ask for certified copies of the documents filed in the suit. Hence, the petitioners were not entitled to the certified copies of the documents filed before the arbitrator.
6.
Therefore, leaving it open to the petitioners to ask only for certified copies of all the materials filed along with the execution petition alone, the Civil Revision Petition is dismissed. Consequently, miscellaneous petitions if any pending in the revision shall stand dismissed. No order as to costs. __________________________ V. RAMASUBRAMANIAN, J ________________ N.
